Tipspiration 3: Final offer of FAPE


Hey there this is our third tipspiration where I just kind of pop in and do this impromptu uh live video for you recently I was in an IEP meeting and there have been several meetings with the school district and there has been a little bit of movement and agreement but not enough so the family was considering using more formal dispute resolution processes and The points that I wanted to make sure that they understood is in my opinion and I’m an advocate I’m not an attorney so please remember that but in my experience it is very helpful that you have a final offer of FAPE from the district before you pursue any other formal resolution process this so we have had a draft IEP Kind of going back and forth through email with suggestions the district reminded us in their last email that this was a draft and it was not their final offer of FAPE so to me that was a signal that when we have our next meeting we need to make sure that we have that final offer of FAPE before the meeting Otherwise these back and forth meetings can just keep going in time is marching and schoolers marching along and I just have seen too much wasted time so what we one of our big goals was to have more conversation with the district but the big goal was at the end we needed to know if this was the districts final IEP that they we’re gonna be offering the family um we Yes it was their final offer we were tape recording so to me that’s important and we are now ready to go on and look at other types of more formal dispute resolution process um in my experience if a family tries to do something like filed for due process when they haven’t received any final offer of FAPE from the school district it Because the school district’s position will be you know we don’t even have a final offer yet and the parents are already pursuing something else so the district would probably get more time to talk with the family so you wanna make sure there’s that final offer before you use other options and speaking of other options this Thursday on my weekly live show it’s at Mountain time 2 PM eastern time we have a wonderful advocate Sarah Davis from the Washington dc metro area and she is going to be specifically talking about other options you have for when you have a dispute that just doesn’t seem to go away or get settled so I hope you can join us Thursday in mountain time 2 PM eastern time right here and we’ll be talking more about dispute resolution processes Options and there are pros and cons to all of them right um and that is something else that we’ll be exploring on Thursday so I hope you guys are having a good day if you are here live and you have a question type it in and I can see your comment if you’re watching the replay and have a question or comment know that you can always type it in and I will circle back and look at And be able to respond so this is our quick tips preparation for the day make sure you have a final offer of faith before present uh pursuing any kind of formal dispute resolution and we shall see you next time take care bye bye
