13 Investigates: Indiana leash law

>>>THIS 113 INVESTIGATES.>>TONIGHT AT 6:00 ON 13, TAKE A LOOK AT THE VIDEO. REALLY QUICK THINKING BY A MAIL CARRIER HELPED HIM TO ESCAPE A VICIOUS ATTACK. THE STORY DOESN’T END THERE.>>DOG OWNERS ARE SUPPOSED TO KEEP PETS ON A LEASH. WHEN RULES ARE BROKEN, PEOPLE AND PETS GET INJURED.>>HOW NEIGHBORS GET CAUGHT IN THE FRAY AND END UP PAYING THE PRICE.>>NO ONE SAW IT COMING. ONE MINUTE A LOCAL MAIL CARRIER CLIPPING ALONG HIS ROUTE, AND THE NEXT SHEER PANIC AFTER TWO VICIOUS DOGS RUN AFTER HIM. WHERE MARCUS FRENCH LIVES.>>I REMEMBER MY MOM YELL, DID YOU DROP THE MAIL ON THE WAY, AND THE ALARM ON THE TRUCK IS GOING OFF. AND I SAID, NO. I LOOKED AT CAMERA. AND I SAID HE’S SITTING ON THE BACK OF THE TRUCK.>>SAFE BY SHAKEN ON THE BACK OF THE CUSTOM DODGE PICKUP.>>HE USED THIS AND THEN LEVERED HIMSELF HERE AND JUMPED ON THE BACK. AND THERE’S THE STUFF FROM HIS SHOE RIGHT HERE.>>REPAIRS, MORE THAN 4400 DOLLARS. ACCORDING TO THE ESTIMATE, CUSTOM FADED TWO POINT POINT CAN’T BE DUPLICATED. THEY NEED TO PAINT THE ENTIRE LEFT SIDE. HE FILED A CLAIM WITH THE UNITED STATES POSTAL SERVICE DAYS AFTER THE INCIDENT LAST SEPTEMBER. JUST WEEKS AGO, NEARLY SIX MONTHS LATER, HE FINALLY GOT HIS ANSWER. IN A LETTER THE POSTAL SERVICE DENIED THE CLAIM SAYING THE INVESTIGATION OF THE MATTER FAILED TO ESTABLISH A NEGLIGENT ACT. OMISSION ON THE PART OF THE U.S. POSTAL SERVICE OR ITS EMPLOYEES. IN ADDITION, YOUR NEIGHBORS AT LARGE DOG WAS IN VIOLATION OF INDIANAPOLIS, INDIANA’S LEASH ORDINANCE CODE. WE REGRET DAMAGES OR INJURIES THAT MAY HAVE OCCURRED, WE CAN NOT ACCEPT LEGAL LIABILITY FOR THEM. FRENCH WAS LEFT WITH JUST TWO OPTIONS. EITHER FILE A LAWSUIT AGAINST HIS NEIGHBORS OR MAKE A CLAIM ON HIS OWN INSURANCE FOR THE REPAIRS AND HAVE HIS INSURANCE COMPANY GO OVER THE DOG’S OWNERS.>>THE POST OFFICE SHOULD PAY FOR IT AND GO AFTER THEM FOR THE MONEY. I AM INNOCENT. DON’T WANT TO CAUSE A A CONFLICT WITH MY NEIGHBOR.>>AN AT LARGE DOG RESULTS IN THE FINE OF AT LEAST $100. FRENCH SAID IT DID NOTHING FROM STOPPING THE DOGS IN THE NEIGHBORHOOD.>>IT’S BEEN AN JOHN GOING ISSUE WITH THE DOGS. A WEEK AFTER THE SITUATION WITH THE TRUCK, THEY KILLED A DOG, AND THEY STILL HAVE THE DOGS TO THIS DAY.>>THE MAIL CARRIER FOUND SAFE REFUGE FROM AN ATTACK ON TOP OF HIS BELOVED PICKUP.>>I UNDERSTAND THERE’S A LEASH LAW. IT KIND OF MAKES ME WONDER WHERE THE LINE IS DRAWN IN A SITUATION LIKE THIS. THOSE AREN’T MY DOGS. I’M NOT RESPONSIBLE FOR THAT.>>NOW WE WERE NOT ABLE TO REACH THE DOG’S OWNERS. WE WANT TO POINT OUT THAT UNSECURE FENCING IS ALSO A VIOLATION. THE FINES IN MARION COUNTY RUN FROM $100 TO $500 IF ANOTHER ANIMAL OR PERSON IS INJURED. A COURT COULD ORDER THE ANIMAL BE FORFEITED OR PUT DOWN. UNDER THE DOG LIABILITY LAW, THE OWNERS COULD FACE CRIMINAL CHARGES. SCOTT, OF COURSE NOBODY WANTS THAT.>>OF COURSE. THE CASE HAPPENED IN MARION COUNTY. DO MOST CITIES HAVE LEASH LAWS?>>THEY ABSOLUTELY DO. AND A GOOD TIME TO CHECK ORDINANCES AS THINGS WARM UP. THE ONLY EXCEPTIONS ARE VISITS TO A DOG PARK. HAMILTON COUNTY HAS A PUBLIC
